Bristol Estate Phase 2 - First Tier Tribunal Decision

Report of Executive Director for Neighbourhoods, Communities & Housing (copy attached).

 

Decision:

(1)  That the committee notes the decision of the First-Tier Tribunal in relation to these works along with the implications for other, similar works of repair undertaken or to be undertaken in the future by the council where service charges for major works of repair may be disputed in a similar way.

 

Minutes:

60.1   The Committee considered a report of the Executive Director, Neighbourhoods, Communities & Housing which looked at the decision and gave thought to similar issues which might arise, relating to the First-Tier Tribunal Property Chamber decision of 18 October 2018 on the liability of leaseholders to pay service charges at five high-rise buildings on the Bristol estate. The tribunal has published the decision notice online as a public document. 60.2   The report was presented by the Leasehold Services Manager accompanied by the Business & Performance Manager. 

 

60.3   Councillor Mears thanked officers for presenting the detailed report to the committee. 

 

60.4   The Chair stated that it was an interesting read and thanked officers.

 

60.5   RESOLVED:-

 

(1)            That the committee notes the decision of the First-Tier Tribunal in relation to these works along with the implications for other, similar works of repair undertaken or to be undertaken in the future by the council where service charges for major works of repair may be disputed in a similar way.
